Terms and Conditions

Using the site

You may browse this site for personal, lawful community purposes. Do not interfere with its operation, attempt unauthorized access, introduce malicious code, or use it to harass, threaten, impersonate, or violate another person’s rights.

Community content

Stories, captions, comments, and photos may reflect the views of their contributors, not necessarily every member of the community. Submit only material you are entitled to share and that does not infringe privacy, publicity, copyright, or other rights.

Permission to display submissions

If you send content for publication, you grant the site operator permission to review, format, and display it for the community website, unless you and the operator agree otherwise. This permission does not transfer your ownership of the content. Do not submit material if you do not accept this limited use.

Accuracy and availability

We try to keep pages accurate and available, but content may be incomplete, outdated, or temporarily unavailable. We may edit, suspend, or remove pages and submissions without notice when reasonably necessary.

Third-party links

Links to other websites are provided for convenience. We do not control those sites and are not responsible for their content, privacy practices, or availability.

Disclaimer and limits

To the extent permitted by law, the site is provided as-is and without guarantees that it will be uninterrupted, error-free, or suitable for a particular purpose. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.

Changes and contact

Terms may be updated as the site changes. The current version is posted on this page. Questions may be sent through the website contact page. Continued use after a posted update means you are using the site under the revised terms, subject to applicable law.

Effective date: October 20, 2026. This page was last updated October 20, 2026.

Account and feature responsibilities

If the website introduces membership or account functionality, each participant must provide information that is reasonably accurate, protect access credentials, and promptly report suspected misuse. Account sharing may create risks to the account holder and other participants. The operator may set additional feature rules before an account-based service is made available. No account or membership feature is created by these terms alone, and a visitor should not assume that a public guestbook entry is an account, subscription, or contractual membership.

Respectful participation

Community discussion should remain relevant to the website’s purpose. Participants must not threaten, stalk, discriminate against, or repeatedly target another person. Disagreement about memories or events should be expressed without personal attacks. Do not publish private addresses, private phone numbers, private correspondence, or information that could put someone at risk. The operator may remove content that creates a reasonable privacy, safety, or legal concern, even if the contributor believes the content is accurate. These rules apply to names, captions, comments, photographs, and links.

Contributor warranties

By submitting content, you represent that you created it, own the necessary rights, or have permission to submit it; that the submission does not knowingly violate another person’s copyright, trademark, privacy, publicity, or other rights; and that you have authority to grant the license described in these terms. You also represent that the content is not unlawful and does not contain malware or deceptive links. These representations do not require a contributor to guarantee facts beyond their knowledge, but they do require honest handling of rights and permissions.

Copyright complaints

A person who believes material on the site infringes copyright may contact the operator with the identification of the copyrighted work, the challenged page or material, contact details, and a good-faith explanation of the concern. A formal notice under the Digital Millennium Copyright Act should include the elements required by 17 U.S.C. § 512(c)(3), including the required statement under penalty of perjury and a physical or electronic signature. The operator may remove or disable access to material and may notify the contributor. Knowingly materially misrepresenting infringement may carry legal consequences. This paragraph is not a substitute for the statutory process.

Privacy and publicity permissions

A contributor must consider whether an identifiable person’s image, voice, name, or story can lawfully be published. Permission may be required depending on context, jurisdiction, and the nature of the use. California privacy and publicity laws and similar rules elsewhere may apply. Do not assume that taking a photograph at a gathering automatically grants unlimited publication rights. The operator may request a release or other confirmation, decline material, or remove content when the permission basis is uncertain or disputed.

Moderation decisions

The operator may organize, format, or edit submissions to maintain readability and site design, but should not materially change the meaning of a contributor’s statement without an appropriate basis. The operator may reject spam, irrelevant material, unsafe links, abusive content, or content that creates legal risk. Moderation is not a promise to review every entry before it appears, and it is not an endorsement of published opinions. A participant may ask for review by identifying the content and the concern, but the operator retains reasonable editorial discretion subject to applicable law.

No guarantee of preservation

The website is not a guaranteed archival service. Technical failures, security incidents, provider changes, or editorial decisions may affect access to material. The operator intends ordinary updates to preserve community data separately from replaceable website files, but contributors should maintain their own copies of irreplaceable photographs and messages. No visitor should rely on the guestbook as the only copy of a family record, invitation, or historical document. A backup is a recovery measure, not a promise of permanent storage.

Third-party content and links

A link to a business, venue, platform, or community organization is supplied for convenience and may become inaccurate or unavailable. The operator does not control third-party services, their products, terms, privacy practices, or accessibility. A link does not constitute a recommendation or guarantee. Participants may not submit links that contain malware, phishing, deceptive redirects, unlawful material, or unrelated promotions. The operator may remove external links that are broken, unsafe, or inconsistent with the site’s purpose.

Consumer rights and governing law

California law and applicable United States federal law govern these terms to the extent permitted, while mandatory consumer protections in a visitor’s jurisdiction remain available. Nothing in these terms waives rights that cannot lawfully be waived, including applicable California consumer protections or statutory remedies. For international visitors, local laws may impose additional requirements concerning online services, privacy, or dispute resolution. The parties do not select California law to defeat a mandatory rule that would otherwise apply. The United Nations Convention on Contracts for the International Sale of Goods is excluded to the extent it could apply.

Updates and severability

The operator may revise these terms as features or legal obligations change. The current terms will be posted on the website; where affirmative consent or advance notice is required, the operator will follow that requirement. If one provision is unenforceable, the rest remains effective as far as law permits. A failure to enforce a term on one occasion does not waive the right to enforce it later. Questions about terms or a submission should be sent through the contact method published on FILMANTRA.FYI.

Contributor responsibility and permissions

A contributor must have the right to submit any text, photograph, artwork, or recording provided to the site. Do not copy another person's private message into the guestbook without permission, or upload a photograph obtained from a restricted group on the assumption that it is free to republish. If a story includes quotations, song lyrics, substantial passages from a book, or a third party's creative work, obtain permission or make sure a lawful exception applies. Contributors should identify any relevant credit or restriction when submitting material. The operator may ask for clarification or proof of permission and may decline content where rights are uncertain. Submitting material does not create an employment, agency, partnership, or fiduciary relationship with the operator.

Respectful participation and safety

Community participation should remain considerate and focused on shared memories and local experiences. Disagreement about a recollection is permitted, but threats, repeated targeted insults, stalking, discriminatory abuse, or attempts to intimidate another participant are not. Do not use a page to publish someone's current location, personal telephone number, private email, family details, or other identifying information without a lawful basis and appropriate consent. Do not use the guestbook to coordinate unlawful activity or to solicit money through deceptive claims. The operator may preserve a record of abusive activity for moderation or legal purposes and may restrict a participant's ability to post. Restrictions should be proportionate to the concern and do not promise that every harmful submission will be detected immediately.

Copyright complaints

If you believe material on FILMANTRA.FYI infringes copyright, send a notice through the site's published contact method with enough information to identify the work and the allegedly infringing page. A notice should identify the claimant and provide contact information, describe the protected work, identify the material to be reviewed, and explain the basis for the claim. A United States copyright notice intended to invoke the Digital Millennium Copyright Act safe-harbor process must satisfy the statutory requirements, including the required statements and signature. The operator may remove or disable access to material, contact the contributor, or request additional information. Knowingly making material misrepresentations in a copyright notice may have legal consequences. This summary is not a substitute for the statutory process.

No guarantee of preservation

The site is a community project, not a guaranteed archival repository. Although the operator intends to preserve guestbook entries through routine website updates, service interruption, corruption, accidental deletion, hosting changes, or a legal request may affect availability. Contributors should keep original copies of photographs and important messages. The operator may migrate data to a new format or provider, and may remove spam, duplicates, unlawful material, or content that presents a serious privacy concern. A migration should be performed with reasonable care, but the operator does not guarantee that every historical display detail, timestamp, or formatting choice will remain identical. A contributor's permission for publication does not require the operator to keep a submission online forever.

Disputes and consumer rights

These terms are not intended to require a consumer to give up a right that applicable law makes nonwaivable. If a dispute arises, the parties may first exchange a clear written description of the concern and attempt a practical resolution, such as correcting a page or removing a contribution. This informal step is not a mandatory condition to exercising a legal right unless a separate valid agreement says so. California law may govern many site-related questions, but consumer protection statutes, privacy rights, and other mandatory rules can apply based on a person's location and the circumstances. Any provision that is unenforceable in a particular jurisdiction should be limited only to the extent necessary, while the rest of the terms remain in effect where lawful.

Accounts, passwords, and feature changes

If the website introduces a password-protected account or member area, users must keep credentials confidential and promptly report suspected compromise. Users must not share an account in a way that bypasses access restrictions or allows another person to impersonate them. The operator may suspend a compromised account to protect the site or its participants and may require a password reset after a security incident. These terms do not create a promise that a membership, paid service, or account feature exists today; any future paid feature should have clear separate terms, pricing, cancellation rules, and support information before a visitor is asked to purchase it. The operator may change or discontinue features, but will respect applicable consumer and contract obligations for any service already purchased.

Interpretation and lawful requests

Nothing in these terms requires a participant to violate a law, disclose another person's confidential information, or waive a right that cannot legally be waived. The operator may respond to valid subpoenas, court orders, or other lawful demands, while reviewing their scope and seeking to disclose only information reasonably required. A request from a private individual is not automatically a legal order and may be evaluated separately. Where legally permitted, the operator may notify an affected contributor before disclosure, but notice may be prohibited or inappropriate in some circumstances. The site may retain a limited record of a request or response to document compliance, protect against repeated abuse, or resolve a dispute. This clause does not guarantee that the operator can challenge every demand or that notice will always be possible.
